Please read this document before signing the subscription application or using RogueLink services.
Use of the RogueLink System constitutes acceptance of the terms and conditions described below.
General
1.Client understands that use of RogueLink services constitutes agreement to all
RogueLink LLC
policies as they currently stand or may be altered in the future. We reserve the right to
alter policies as needed to assure safe and equitable use of the system. Current policies

2. Some material available on the Internet will be objectionable to some users.
RogueLink,
LLC is not responsible for Information found on the Internet nor the resulting use of said
information. Minors under the age of 18 must have their legal guardian sign the
subscription agreement. Site blocking software is available from area software vendors.
3. RogueLink makes no warranty of its service and availability. While a good faith effort
will be made to restrict any and all downtime to scheduled maintenance periods, no
guarantees are made as to any account, product, or service offered by RogueLink.
RogueLink
makes no warranty of Client transmissions, connections, downloads,etc. Client is solely
responsible for any losses, damages, or expenses related to service failure, whether
caused by RogueLink, the Client, or a third party and agrees that RogueLink shall not be
liable for any or all of the same.
Services
4. RogueLink LLC will assist in the initial configuration of one (1) computer per account
purchased. Such assistance shall be subject to all applicable conditions listed herein.
Technical assistance, either in person or over the phone, offered as promotion or goodwill
shall be charged to the client if the account terminates within six months of the date of
such service.
5. Internet installations performed by RogueLink include configuration of Internet
components only and assume the client's system has the capacity for such operations and is
in good working order. Any work requested and performed beyond the scope of the Internet
connection is done at the client's expense. Installations that are unsuccessful or require
subsequent visits due to malfunction of the client's equipment or software are
subject to a minimum service call fee and hourly charges.
6. The client understands that subscribing to RogueLink provides access to our equipment for
using the Internet only. The client is solely responsible for maintaining, repairing,
learning to use and continued responsible use of their own equipment. Assistance in any of
these areas is available for an additional charge.
Acceptable Use Policies
7. Clients may be provided with or may select a username and confidential password
for client's exclusive use. Client is expected to maintain a secure password and agrees to
pay and be responsible for all usage of this identification code. Client will
be held liable for any actions taken by an individual or group who have obtained/guessed the Client's password
and used it to access his account. Client understands that RogueLink is not liable if Client
username, password, and/or data are compromised and under no conditions will
RogueLink
LLC be liable for any actions taken with a compromised account. . Client
understands that RogueLink may not maintain a record of existing passwords. If you forget
your password the only recourse may be for RogueLink to issue a new one upon verification of
the caller's identity and charge an administrative fee.
8. Users are permitted only ONE of our modem lines at a time. Idle dial-ins and logins for
more than 20 minutes will be disconnected without warning. Initiating any program or
process to maintain active status when the connection is not actually in use
by the subscriber is prohibited.
9. Disk space limits may be imposed if they are required to maintain fair use of the
system. Client acknowledges that RogueLink reserves the right to move, delete, or
reduce the Client's mailbox or web site if either has reached a size that is adversely
affecting system performance. Storage for Personal PPP accounts is limited to 5 MB per
month, and includes your home directory and your email file. Excess storage is charged at
a rate of $1 per MB per month, but is not guaranteed.
TERMINATION, CANCELLATION AND SUSPENSION OF SERVICES
10. Client understands that nonpayment of services shall not constitute a formal
termination of charges with RogueLink LLC. The account is considered active, for use and
billing purposes, until RogueLink receives written or verifiable email notification that the
client wishes to terminate the account.
11. RogueLink, LLC reserves the right to refuse service to any user. RogueLink reserves the
right to terminate or suspend an account without notice for any activity deemed
unreasonable by Management or System Administration staff. Such activity may
include (but is not necessarily limited to):
12. Violators will be liable for all expenses related to the research,
repair and rectification of an activity that engages our company time and
resources. A charge of not less than $100 per incident will be
imposed by RogueLink management. All legal expenses will
be the responsibility of the violator.
Billing
13. RogueLink, L.L.C. reserves the right to change the rates and otherwise modify
these Terms and Conditions by notifying the subscriber by email 30 days in advance of the
effective date of the change.
14. Subscriber agrees to pay all service fees for connection to, and use of,
the Internet through RogueLink, L.L.C according to tariffs based on personal or business
uses of the server space allocated to the subscriber. Any business use of space allocated
for personal accounts as determined by RogueLink will automatically upgrade the subscribers'
account to the business rates. "Business use" is defined as any material
published to display products or services for sale.
15. Accounts are invoiced monthly in advance by email (unless a postal bill has
been requested) and may be canceled in writing with 30 days notice without
penalty. Clients are responsible for updating email and physical address billing
records to ensure receipt of invoices. Statements shall be paid no later
than the service period start date and are subject to disconnection without
further notice if not recorded within 10 days of the service start date. Accounts that are disconnected
for non-payment and later reinstated will be charged a $20 reconnection fee. No refunds
are issued for suspended periods. A service fee of $25.00 will be charged on all returned
checks or declined bankcards. In case of default, client agrees to pay RogueLink, L.L.C. all reasonable collection expenses incurred in enforcing its rights.
16. Past due accounts are considered delinquent at 30 days and shall be assessed a late
charge of 1.5% per month or the maximum allowed by state laws.
17. Should the client choose to cancel their account before the six-month anniversary of
receipt of any unpaid promotional advantage or technical or consulting services, s/he will
be responsible for full payment of said services at the current rates.
18. In case of errors or questions about a bill, the Client will refer queries as soon as
possible to RogueLink Accounting Department no later than 30 days from the billing date of
the first bill on which the problem or error appeared.
